TCAS: The Tribunal Mind: Group Decision – Making in International Arbitration
Decision-making in international arbitration has long focused on individual bias, but most arbitral awards are written by panels of three. International arbitration lawyer and cognitive psychologist Ula Cartwright-Finch’s keynote presentation will draw on research in group cognition, collective intelligence and social neuroscience to explore how tribunal decision-making really works: from cognitive diversity and information-sharing to empathy, influence and the structure of deliberation. Moving beyond individual bias, it reframes arbitral tribunals as collective cognitive systems – and considers how tribunal thinking could be enhanced.
